It is likely that much of what was done here is a violation of either the HOA or Condo bylaws or California law, or both. If you want to challenge this action, you need to get informed about what the Board should be doing with regard to elections and also with regard to open, closed (executive session), and emergency meetings. There are a lot of free articles on the Guru website about elections under the link "California HOA Elections Requirements", and several Primers and other affordable educational publications available on the publications page of my website. I also have another blog and have written about these kinds of things on many occasions. That blog is called the California Condo & HOA Law blog. I have been writing about these things for many years. The elections laws are fairly new (effective in 2006) and many HOA boards simply do not know about them. You could educate your board!

Dear Beth: Hi. Our HOA is in the state of CA. We just learned yesterday, (after 4 months of zero monthly meetings), that there is an HOA meeting tomorrow. The President is going to appoint two board members without having an election. Can this be done? Also, no one was informed of this emergency meeting. I would like to run for office but need your advice.

Thanks for your ideas and help. Beth
