Are You The Owner With The Bad Tenant? Do Something About It! And I don’t mean make the association your scapegoat.

I get emails all the time from association board members and from owners complaining about bad tenants. Some are really bad. Some are victims of picky neighbors, who often are on the board, and have the advantage of leading the discussions about their “bad” neighbors.

I have seen all kinds of things, but this email is about the really bad tenants, like the adult son who menaces his own mother, or the families that move in and have little or no regard for the neighbors, who thumb their nose at the neighbors and threaten to sic their pitbulls or teenagers on them when they complain.

Owners are responsible for their tenants actions, responsible for the fines that are incurred from disturbances, responsible for any injuries inflicted on the other residents, responsible for dog bites, common area damage, parking, noise, and other fines. The HOA does not have a legal relationship with the tenants, but does with the owners. An HOA does not want to form a legal relationship with the tenants, even when they welcome tenants into the community. Boards should not do anything that leads an owner to believe that the HOA is responsible for the bad tenant. The owner is responsible for the bad tenant!
