CHANGES TO A CONDO OR HOA UNIT – IS A VERBAL YES ENOUGH?

Here is a question from a reader. It’s about a modification to a unit:

“Our HOA bod member gave me a verbal yes on a modification to my unit then after a conversation with another BOD member he said he changed his mind. Can I hold him accountable to the yes?”

I have yet to see a set of governing documents that allows for a verbal “yes” or “no” on an application for approval of a modification. When there are requirements for architectural approval for changes, the documents will likely say that approval has to be “written” or “in writing”. And furthermore, board members should know this, and should not be approving or denying modifications on a site visit. Site visits are generally for gathering information to provide the committee or board so it has more information when making a decision.

There are lots of things wrong with this “picture”.
