My latest raft of E-newsletters has been on the topic of HOA elections. I talked about election laws and requirements, missteps, and outright bad behaviors.

I received an email from a person on the E-newsletter list that sees things from a different perspective and I think it’s good to share these things. There are many good volunteer board members in HOAs in California who do everything right, or perhaps accidentally miss some detailed technical aspect of the law, and get pounded. There are some that have to deal with owners who pound continuously without any willingness to try and work to make things better by serving on the board or offering constructive suggestions.  And there are some owners who would not be happy in any HOA.

I want to share this alternative perspective – sometimes the owner doing the complaining is the problem. One rampantly complaining owner can cause an HOA Board a ton of exasperation and a boatload of money.

I agree with your observation why one would not sell out in order to escape a toxic situation. At the same time, I observe that as often as not, the problem can be the personality as well as the merits of an issue. . .e.g. no matter where they are, they will never be happy.”

The above is true, some owners will not be happy in any HOA.

There is a case I will be talking about where an Association effectively addressed a vexatious litigant in court. I will be helping to clarify an understanding of what situations suggest a vexatious litigant and what a board can do about it.
